1. Introduction

Any person accessing this platform is subject to, and agrees to, the terms and conditions set out in this document. If you do not wish to be bound by these terms and conditions, you may not access, use, or otherwise interact with this platform.

Each time you access and/or use the services on this platform, you shall be deemed to have consented to the Terms, as amended from time to time.

2. Definitions

  • "Student" means a registered student seeking accommodation
  • "Landlord" means an accommodation provider registered on the Platform
  • "Booking" means a reservation of accommodation made through the Platform
  • "NSFAS" means the National Student Financial Aid Scheme

3. Acceptance of Terms

By signing in or signing up, you agree to the terms and conditions set forth herein. We may modify the Terms from time to time, and amended Terms will be made available via the Platform. By continuing to use the Platform, you agree to be bound by the amended Terms.

4. User Registration

To use certain services on this Platform, you must register an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorised use of your account
  • Only use your personal profile when transacting on the Platform

If you are under the age of 18, you must obtain your parent's or legal guardian's authorisation before using this Platform.

5. Communications

By using this Platform, you agree to receive emails and SMS messages from NSFAS and related service providers. These communications may include:

  • Booking confirmations and updates
  • Payment notifications
  • Important service announcements
  • Verification codes (OTP)
  • Reminders and alerts related to your accommodation

6. Platform Integrity

To protect the integrity of the Platform, you agree that you shall not:

  • Use any automated tools, robots, or scrapers to access the Platform
  • Attempt to gain unauthorised access to any part of the Platform
  • Post or transmit any viruses, malware, or harmful code
  • Attempt to reverse-engineer or decompile any part of the Platform
  • Use the Platform in a manner that would bring NSFAS into disrepute
  • Use the Platform for any unlawful purpose

7. Bookings and Payments

When making bookings through the Platform:

  • All bookings are subject to availability and landlord confirmation
  • Payment terms are as stipulated by NSFAS guidelines
  • All payments shall be made in South African Rands (ZAR)
  • Booking details are captured at the time of booking for audit purposes
  • Cancellation policies apply as per the specific booking terms

8. Intellectual Property

All content, trademarks, logos, and intellectual property on this Platform are the property of, or are licensed to, NSFAS and are protected by applicable laws. You may not reproduce, duplicate, or copy any content without prior written consent.

9. Disclaimer

While every reasonable effort is made to maintain current and accurate information on this Platform:

  • We accept no responsibility for errors or omissions
  • The Platform is provided "as is" without warranties of any kind
  • We do not warrant that the Platform will be error-free or uninterrupted
  • Information on accommodation properties is provided by landlords and we do not verify all claims

10. Limitation of Liability

To the extent permissible by law, neither NSFAS, its affiliates, shareholders, agents, consultants, nor employees shall be liable for any direct, indirect, special, incidental, consequential, or punitive damages arising from your use of the Platform.

Your use of this Platform and the information contained herein is entirely at your own risk.

11. Privacy

Your use of this Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your Personal Information.

12. Breach

We are entitled, without notice, to cancel these Terms, limit or deny your use of the Platform and services, should you:

  • Breach any of these Terms
  • Use the Platform in an unauthorised manner
  • Infringe any statute, regulation, or law

13. Governing Law

These Terms shall be governed in all respects by the laws of the Republic of South Africa. This Platform is controlled, operated, and administered from within South Africa.

14. General

  • If any provision of these Terms is held to be illegal or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
  • Our failure to act with respect to a breach does not constitute a waiver of our right to act with respect to subsequent or similar breaches.
  • You may not assign your rights or obligations under these Terms without our prior written consent.
  • These Terms set forth the entire understanding between you and NSFAS with respect to the subject matter hereof.
